Under the criminal law, it is provided that the burden of proof lies with the state wherein the burden of proof under civil law lies on the plaintiff. The criminal law requires the state to prove the defendant guilty whereas the plaintiff shall prove the guilty nature of the act of defendant. The proof is in regards to the committal of the crime by the defendant. The civil law deals in cases between the individuals wherein the criminal law deals in the criminal offences. The purpose of the civil law is to resolve the disputes between individuals or organisations whereas the criminal law maintains the stability between the state and the society. (Burns, 2007)
